Liability Waiver & Agreement, Parent/Guardian Consent and Release of Liability
Business Name: Sunshine Play Café Corporation, carrying on business as Sunshine Play Café
Address: 1 Toronto Rd, Flesherton, ON, N0E 1H0
Contact: playcafesunshine@gmail.com 705-607-2807
Agreement version: Version 1, October 2026
IMPORTANT: READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT AFFECTING YOUR RIGHTS.
1. Adult Agreement and Child Consent: I confirm that I am at least 18 years old and, for each child listed, am their parent or legal guardian with authority to consent to participation.
By signing this single agreement, I accept its terms for myself and consent to the listed children participating in age-appropriate play at Sunshine Play Café. Each accompanying adult must sign their own agreement.
2. Acknowledgment of Risks: I understand that play and café visits involve risks, including slips, falls, collisions, equipment-related injuries, cuts, fractures, head injuries, choking, burns, allergic reactions, infectious illness, property loss, permanent disability and death. Supervision, inspections, cleaning and safety rules reduce risks but cannot eliminate them. I will select activities appropriate to each child’s abilities and stop participation when unsafe.
3. Supervision and Play Rules: Sunshine Play Café does not provide drop-off childcare. I must remain on-site and actively supervise the children in my care, with at least one supervising adult aged 18 or older. I agree to follow posted equipment restrictions and reasonable staff directions; prevent running, pushing, rough play and unsafe climbing; keep food and drinks outside the play area; keep exits clear; and promptly report injuries, spills and hazards. The play space is designed for ages 0–6. Strollers are not permitted inside, subject to disability-related accommodations. Staff may pause unsafe activities or require visitors to leave a play area when reasonably necessary, subject to applicable accommodation duties.
4. Grip Socks and No Shoes: Adults and children must remove shoes and wear clean, properly fitting non-slip grip socks in the designated play area. Regular socks and bare feet are not permitted. Non-mobile infants remaining with their caregiver are exempt. Grip socks are available for purchase. Visitors requiring medical footwear, mobility aids or another disability-related exception should speak with staff, where practicable. Accommodation will be assessed individually and provided as required by Ontario law. Necessary mobility aids do not have to be removed. Grip socks cannot prevent every fall or injury.
5. Food and Allergies: Sunshine Play Café operates a gluten-free and peanut-free kitchen. Milk and egg ingredients are used, and some dairy-free and egg-free options are available. These practices do not guarantee the absence of allergens or cross-contact. I will disclose relevant allergies before ordering, review available ingredient information, confirm suitability on each visit, supervise eating and keep prescribed emergency medication readily available. Allergic reactions, including anaphylaxis, may cause serious injury or death. Outside food and drinks are prohibited except breast milk, infant formula or an accommodation approved by management. This acknowledgment does not excuse inaccurate ingredient information, unsafe food handling or responsibilities that cannot lawfully be excluded.
6. Illness and Emergencies: Shared indoor spaces carry a risk of communicable illness. I will follow the café’s illness policy and applicable public health directions and will not attend with vomiting, diarrhea, fever with illness symptoms or when directed to isolate or remain home. In an emergency, staff may call 911, provide first aid within their training and share information reasonably necessary to assist emergency responders. This does not authorize staff to make treatment decisions reserved by law to a capable patient or authorized substitute decision-maker.
7. Adult Release of Liability: In consideration of being permitted to enter and use Sunshine Play Café, I voluntarily accept the risks described above concerning my own attendance and participation. To the fullest extent permitted by Ontario law, I release Sunshine Play Café Corporation, operating as Sunshine Play Café, and its owners, directors, officers, employees and volunteers acting in connection with the café (“Released Parties”), from claims I personally have for injury, illness, allergic reaction, disability, death or property loss arising from my covered visits, participation or consumption of food or beverages.
THIS INCLUDES CLAIMS ARISING FROM THE RELEASED PARTIES’ NEGLIGENCE concerning premises, equipment, inspection, maintenance, cleaning, food preparation, allergen communication or other café operations, only to the extent such claims may lawfully be released. This release does not cover intentional misconduct or liability that cannot lawfully be excluded. It does not release another adult’s claims or a child’s independent claims and does not require me to reimburse the Released Parties because a child brings a claim. My supervision responsibilities do not remove the café’s legal duties.
8. Twelve-Month Validity: This agreement applies for 12 months from signing to my visits and the listed children’s ordinary play sessions, membership or pass visits, ordinary play during parties or private bookings, and associated café use. I authorize the café to securely retain this agreement and use it for these repeat visits without a new signature each time. It does not renew automatically. I will report changes to contact information, relevant allergies, accommodation needs or my authority to consent. Adding a child requires a new signed agreement or signed amendment. Material changes to this agreement or activities with materially different risks require additional agreement before they apply. I may withdraw consent for future participation by writing to playcafesunshine@gmail.com Withdrawal or expiry does not, by itself, cancel the intended application of this agreement to earlier visits, subject to law.
9. Privacy and Legal Terms: Information is collected to administer participation, verify consent, respond to emergencies and manage incidents or claims. This agreement does not provide consent to promotional photography or marketing. Ontario law and applicable Canadian law govern this agreement. Rights and obligations that cannot lawfully be excluded remain unaffected. If a provision is unenforceable, the remaining provisions apply to the extent permitted by law.
I have read this Liability Waiver and Agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law.
